Smith, City Attorney
The City Attorney is a full time elected
office, encompassing a 4 year term, and is responsible for providing
legal counsel for the City. The current City Attorney’s term expires in
2006.
This office is responsible for prosecuting
misdemeanor crimes, traffic violations, and city ordinance violations
for the City of Russellville in District and Circuit Court. These
include DWI, domestic abuse, traffic violations, offenses against
property, etc. In handling criminal cases, this office investigates,
prepares, and prosecutes cases set for trial in District and Circuit
courts. The City Attorney’s Office also takes complaints from victims
which results in the City Attorney sending a warning letter, issuing a
prosecutor subpoena, filing an affidavit or information, or closing the
file. The City Attorney’s Office deals with all crimes of misdemeanor,
traffic citations, and city ordinance violations status which occur
within the Russellville City limits.
The City Attorney’s office provides general
legal advice and work, drafting of ordinances and resolutions, contract
review and drafting, and special services to the City Council, the
Mayor, the Planning Commission, the Board of Adjustments and the Civil
Service Commission as well as City departments and staff. This office
also represents the City in land condemnation and other civil cases in
state and federal courts and in appeals to state and federal appellate
courts in civil matters.
Misdemeanors can be traffic violations
given by police officers, contempts of court, or by an affidavit.
Affidavits for summons on criminal prosecution of alleged criminal acts
(i.e. harassment, harassing communications, domestic battery; thefts
less than $500.00; criminal mischief less than $2500.00; etc) can be
filed in the City Attorney’s office by the victim. |
